You can just go to the doctor with their permission. According to the exception of some possessions related to the child-mamiez in authentic Islamic sources and the permissibility of some legal practices that do not have a financial aspect and are in the interest of the minor child, the permission of the child-mimiz to superficial treatments, i.e. other than heavy tests and surgery, is valid and the Sharia has facilitated the health of the child-mimiz Is. In order to answer the problem and prove the mentioned hypothesis, data collection from principled and jurisprudential sources has been done with the library method, then by analyzing the data using the ijtihad method, the validity of the permission of the child examiner to surface treatment is discovered in the direction of the child's health. The Shariah has supported his health by considering the permission of the child examiner for superficial treatments, in this matter there are two views of the permissibility of relying on the child examiner's permission and the impermissibility of relying on the child examiner's permission, each of which has its own evidence. : Hadith Rifa, narrations of the inadmissibility of the child, reputation, consensus, and narrations of the child's intention being wrong, all of which can be criticized, and the reasons for the permissibility of relying on the permission of the child for superficial treatment are also: the foundation of reason, the rule of mastering the body, various narrations, the rational way of life and the moral way of Shariah. which supports Sharia's support for the health of the child. مسأله اذن و آثار آن در فقه پزشکی، بسیار مهم و دارای نقشی بسزا در روابط حقوقی و اجتماعی پزشک و بیمار است، از طرفی در جمع بیماران کودکانی هستند که می توانند خوب را از بد و سود را از زیان تمیز دهند، این تحقیق به دنبال روشن کردن آن است که حجر کودک، نسبت به رجوع به پزشک و اذن به درمان سطحی، بی دلیل و مانع سلامت کودک است بلکه در راستای حفظ سلامت کودک ممیز در نگاه دین، برای جواز شرعی پزشک در اقدام به درمان سطحی در جایی که آزمایشات و یا جراحی در میان نباشد، می توان به اذن و مراجعه ایشان به پزشک اکتفا کرد. باتوجه به استثنای برخی از تصرفات مربوط به کودک ممیز در منابع اصیل اسلامی و مباح بودن پاره ای از اعمال حقوقی که جنبه مالی ندارد و به مصلحت کودک صغیر است، اذن کودک ممیز به درمان های سطحی یعنی غیر از آزمایشات سنگین و جراحی معتبر است و شرع سلامت کودک ممیز را تسهیل کرده است. در راستای پاسخ به مسئله و اثبات فرضیه یادشده با روش کتابخانه ای به جمع آوری داده ها از منابع اصولی و فقهی پرداخته شده است، سپس با تحلیل داده ها به روش اجتهادی اعتبار اذن کودک ممیز به درمان سطحی در راستای سلامت کودک کشف می شود. شرع با حجت دانستن اذن کودک ممیز به درمان های سطحی از سلامت او حمایت کرده است، در این موضوع دو دیدگاه جواز بسنده کردن و جایز نبودن بسنده کردن به اذن کودک ممیز وجود دارد که هرکدام دارای ادله ای است، دلیل های جایزنبودن اکتفا به اذن کودک ممیز به درمان سطحی، عبارت است از: حدیث رفع، روایات عدم جواز امر کودک، شهرت، اجماع و روایات خطا بودن عمد کودک که همگی قابل نقد است و دلیل های جواز بسنده کردن به اذن کودک ممیز به درمان سطحی نیز عبارت است از: بنای عقلا، قاعده تسلط بر جسم، روایات گوناگون، سیره عقلا و سیره متشرعه که پشتیبان حمایت شارع از سلامت کودک ممیز است. http://fqaht-mpbs.ir/finalFile/1700033812_b077313d4ab5fd335d067bf77e7de9e5.pdf
